Acceptance of terms

These Terms & Conditions (“Terms”) are a binding agreement between you and FitPeo Inc. (“FitPeo”, “we”, “us”). They govern your access to and use of our websites, mobile applications, telehealth services, connected devices and related products and services (together, the “Service”). By accessing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Eligibility & accounts

You must be at least 18 years old and located in a jurisdiction where the Service is available to create an account or receive treatment. You are responsible for keeping your login credentials confidential, for all activity under your account, and for providing accurate, complete and current information, including health history. Notify us immediately of any unauthorized use of your account.

The Service

FitPeo provides a technology platform that connects you with independent, licensed healthcare providers, facilitates prescription fulfillment through FDA-regulated partner pharmacies, and offers health-tracking tools, connected devices and educational content. FitPeo itself does not practice medicine or pharmacy. All medical decisions are made solely by the licensed provider based on their independent professional judgment.

Telehealth consent

By using the Service to consult a provider you consent to receive care via telehealth. You understand that:

• Telehealth involves the electronic transmission of your medical information, images and other data to a provider who may be located elsewhere;
• Providers rely on the information you supply; inaccurate or incomplete information may affect the care you receive;
• A provider may determine that telehealth is not appropriate for your needs and may decline to prescribe or may refer you to in-person care;
• Technical failures may interrupt or delay a consultation;
• You may withdraw your consent to telehealth at any time without affecting your right to future care.

Your health information is protected as described in our Privacy Policy and applicable law.

Not for emergencies

The Service is not intended for medical emergencies. If you are experiencing a medical emergency or thinking about harming yourself, call 911 (or your local emergency number), go to the nearest emergency room, or contact the 988 Suicide & Crisis Lifeline immediately.

Prescriptions & pharmacy fulfillment

Prescriptions are issued only when a licensed provider determines a treatment is medically appropriate for you. There is no guarantee that a prescription will be written. Prescriptions are filled by independent licensed pharmacies, which may include compounding pharmacies for compounded medications. Compounded medications are not FDA-approved and are prepared to a provider’s specifications. Always follow your provider’s and pharmacist’s instructions and read all medication information provided.

Connected devices & app

Smart scales, wearables and other connected devices, and readings shown in the FitPeo app, are wellness tools intended to support your care. They are not a substitute for professional medical judgment and may not be accurate in all circumstances. Do not make medication changes based solely on device readings without consulting your provider.

Payments & subscriptions

You agree to pay all fees displayed at checkout, including applicable taxes. Some treatments are offered as recurring subscriptions; by starting a subscription you authorize us to charge your payment method at the stated interval until you cancel. You may cancel at any time through your account or by contacting support; cancellation takes effect at the end of the current billing period. Prices may change with notice. Provider consultations and medications are generally not covered by insurance through FitPeo.

Shipping, returns & refunds

Prescription orders ship free and discreetly to the address on your account once approved. Because prescription medications cannot be restocked or resold, they are not eligible for return or refund once dispensed, except where required by law or where an error was made by FitPeo or the pharmacy. Non-prescription products and devices may be returned in original condition within 30 days of delivery for a refund of the purchase price, excluding shipping. Open Payments notice

For informational purposes only: the federal Physician Payments Sunshine Act requires manufacturers of drugs and devices covered by federal healthcare programs to report payments and transfers of value to physicians and teaching hospitals. You may search the Open Payments database at openpaymentsdata.cms.gov.

Acceptable use

You agree not to: use the Service for anyone other than yourself; provide false information; resell or share medications; attempt to access accounts or data that are not yours; interfere with the security or operation of the Service; scrape or copy content without permission; or use the Service in violation of any law.

Intellectual property

The Service and all content, software, trademarks and logos are owned by FitPeo or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes. Feedback you submit may be used by us without obligation to you.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Content on the Service is for general informational purposes and is not medical advice; individual results vary and are not guaranteed.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FITPEO AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO FITPEO IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow these limitations, so they may not apply to you.

Indemnification

You agree to indemnify and hold harmless FitPeo and its affiliates from any claims, damages and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

Governing law & disputes

These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration, except that either party may bring an individual claim in small-claims court. YOU AND FITPEO WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

Changes to these terms

We may update these Terms from time to time. Material changes will be posted on this page with a new “Last updated” date, and where appropriate we will notify you by email or in the app. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Contact
